The Programs listed below are licensed under the following terms and conditions in addition to those of the International Program License Agreement.

EXPLANATIONS OF TERMS:

Authorization for Use on Home/Portable Computer:
"1" means that the Program may be stored on the primary machine and another machine, provided that the Program is not in active use on both machines at the same time.
"2" means that you may not copy and use this Program on another computer without paying additional license fees.

Specified Operating Environment

The Program's specifications and specified operating environment information may be found in documentation accompanying the Program, if available, such as a read-me file, or other information published by IBM, such as an announcement letter.

Excluded Components

Notwithstanding the terms and conditions of any other agreement you may have with IBM or any of its related or affiliated companies (collectively "IBM"), the following terms and conditions apply to all "Excluded Components" identified below: (a) all Excluded Components are provided on an "AS IS" basis; (b) IBM DISCLAIMS ANY AND ALL EXPRESS AND IMPLIED WARRANTIES AND CONDITIONS INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF NON-INFRINGEMENT OR INTERFERENCE AND THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE; (c) IBM will not be liable to you or indemnify you for any claims related to the Excluded Components; and (d) IBM will not be liable for any direct, indirect, incidental, special, exemplary, punitive or consequential damages with respect to the Excluded Components.

Program-unique Terms

Charging and License Use Management

Charges for authorized use of the Program are based on 'Processor License Units' (PLUs). The use of the Program on any server machine requires one PLU to be acquired (from IBM or an IBM Business Partner) for each processor or symmetric multiprocessor contained in the server machine on which any copy of the Program is to run. PLU's are required for every server machine on which the Broker component of the Program is installed. You are also required to obtain a corresponding number of additional PLU's if the Program installation is moved to a server machine with a greater number of processors, or if any additional processors are added to the server machine on which the Program is installed.

Failure to comply with requirement for the appropriate number of PLU's will invalidate the terms of this license. License Use Management software is used to monitor compliance.

No separate server authorizations are required to license any other component part of the Program.

You should retain your original product and all Passport Advantage documents as Proof of Entitlement.

Specific restrictions also apply to various components of the Program, as described below.

WebSphere MQ

The Program includes a copy of IBM WebSphere MQ. For each Proof of Entitlement, you are authorized to install and use WebSphere MQ in association with your use of the Program, as follows:

you are authorized to install two copies of WebSphere MQ for use with the Program.
you are authorized to use WebSphere MQ only with messages generated for the Program, and not for other purposes. (To use WebSphere MQ for any other purpose, you must acquire a separate (unrestricted) Proof of Entitlement which authorizes such use of an WebSphere MQ software product.)

DB2 Components

The Program includes portions of IBM DB2 Universal Database ("DB2"). For each Proof of Entitlement of the Program, you are authorized to install and use two copies of DB2 components only in association with your licensed use of the Program for the storage and management of data used and generated by the Program, and not for other data management purposes, specifically excluding use for application data. For example, this license does not include inbound connections to the database from other applications for queries or report generation. You are authorized to install and use one copy of these DB2 components only on the same workstation as the Configuration Manager component provided with your program. The second copy of the DB2 components can only be used by the Broker component of the Program.

Microsoft(R) Data Access Components

The Program includes a copy of Microsoft Data Access Components ("MDAC"). Use of MDAC by you is subject to the terms of the "End User License Agreement for Microsoft Software", a copy of which is included with the Program on the Supplemental CD-ROM.

In particular, you are granted no right or license to redistribute MDAC. If you wish to acquire the right or a license to redistribute MDAC, you should contact Microsoft Corporation to obtain the necessary authorization. At the time of Publication, Microsoft Corporation can be contacted for this purpose via its web page at HYPERLINK "http://www.microsoft.com/data/download.htm"

NOTE: Microsoft Corporation reserves the right to delete the MDAC download and to change, move, or remove the referenced web page at any time, at its sole option.

Use of Hewlett Packard Java RTE V1.3 (for HP-UX only)

The HP-UX version of the Program includes a Java Runtime Environment ("RTE") supplied by Hewlett Packard ("HP"). Any use of the HP RTE is subject to the HP software licensing and warranty terms. Users of the Program will be asked to indicate their acceptance of the HP license and warranty terms, when installing the Program.

If the HP license and warranty terms are not acceptable, then you should return the Program immediately to your supplier, for a full refund of any money paid by you for it.

DataDirect ODBC Driver Manager Components

Portions of this Program are copyrighted by DataDirect Technologies, 1991 - 2002.

IBM Rules and Formatter

The WebSphere Business Integration Message Broker with Rules and Formatter Extension includes certain 'Rules and Formatter' material supplied under license by Sybase, Inc. ("R+F Code").

The following applies in respect of the R+F Code:

- You may not assign or transfer any R+F Code to any other end user;
- Sybase, Inc. DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE USE OF THE R+F CODE INCLUDED IN THE PROGRAM, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE; and
- the aggregate liability of Sybase, Inc. to you for all claims relating to the R+F Code shall not exceed the amount paid by You for the Program .

WebSphere MQ Transport Restrictions

Each WebSphere Business Integration Event Broker, WebSphere Business Integration Message Broker license entitles the licensee to:

1. connect up to 500 WebSphere MQ Telemetry Transport end- points per PLU;
2. connect up to 5 WebSphere MQ Multicast Transport end- points per PLU;
3. connect up to 10 WebSphere MQ Real-Time Transport end- points per PLU;
4. connect up to 25 WebSphere MQ Services Transport end- points per PLU.

A WebSphere MQ Telemetry Transport end-point is defined to be a device that is configured to use Telemetry transports to interact with the broker including those devices connected by an intermediate router, gateway, device or server.

A WebSphere MQ Real-Time transport end-point is defined to be a server or workstation using the Real-Time client supplied with the product to interact with the broker.

A WebSphere MQ Multicast Transport end-point is defined to be a device, server or workstation that is configured to use the Reliable Multicast Messaging protocol or other multicast protocol to interact with the broker, including those connected by an intermediate router, gateway, device or server.

A WebSphere MQ Web Services Transport end-point is defined to be a application that is configured to use native HTTP message protocols to interact with the broker including those connected by an intermediate router, gateway, device or server.

WebSphere Business Integration Connection Pack - License Extensions

A WebSphere Business Integration Connection Pack can be purchased if licensed users of the Program wish to exceed the licensed WebSphere MQ Transport end-point limits for a single chosen transport.

1. WebSphere MQ Telemetry Transport License Extension - Each WebSphere MQ Telemetry Transport license Extension entitles the licensee to connect an additional 1,000 Telemetry end - points to a fully licensed copy of the program.
2. WebSphere MQ Multicast Transport License Extension - Each WebSphere MQ Multicast Transport license extension entitles the licensee to connect an additional 10 Multicast end-points to a fully licensed copy of the program.
3. WebSphere MQ Real-Time Transport License Extension - Each WebSphere MQ Real-Time Transport license extension entitles the licensee to connect an additional 20 end-points to a fully licensed copy of the program.
4. WebSphere MQ Web Services Transport License Extension - Each WebSphere MQ Web Services Transport license extension entitles the licensee to connect an additional 50 end-points to a fully licensed copy of the program.

Each license extension pack may only be used for Web Services end-points or Real-Time end-points or Multicast end-points or Telemetry end-points, and may not be mixed.

Use of Components on separate machines

The Program consists of several components:

1. Message broker
2. Configuration manager
3. User Name Server
4. Database manager
5. Message Broker Toolkit for WebSphere Studio

Each component may be installed on only a single machine, at any one time except for the Message Broker Toolkit for WebSphere Studio, which may be installed on multiple machines provided they are all used in conjunction with the same message broker machine.

You may use the Program's Configuration Manager on the same server machine as the Broker component, or on one Intel-based (*) machine. * Intel machines include compatible processors, such as Cyrix and AMD. (Intel is a trademark of Intel Corporation in the United States, other countries, or both.)

Unit Testing

The Program license authorizes a single developer to install each component of the program on a single Microsoft (R) Windows machine for purposes of "unit testing", which is limited to testing of code written or generated by such developer to confirm that such code functions as designed. Each license does not authorize the following purposes:

1. Testing applications on servers separate from the developer's machine
2. Exchanging messages with any production application or system
3. Simulating production workloads
4. Testing scalability of any code, application or system

Message Brokers Toolkit for WebSphere Studio

The Program includes a copy of the Message Brokers Toolkit for WebSphere Studio, which:

ii) is based on technology from the Eclipse project ( visit http://www.eclipse.org ); and

iii) is subject to the following Eclipse.org Software User Agreement
